A decision rendered last week by State Supreme Court Judge James McCarthy that allows the position of Oswego County Clerk to be on the ballot in November won’t be appealed.
McCarthy ruled that state Election Law and the New York Public Officers Law stating any vacancy occurring before Sept. 20 should be filled at the next general election is valid.
The law was challenged by former legislator James McMahon, who petitioned the court asking that New York State County Law be followed. That law states that a vacancy occurring less than three months prior to a general election be filled by the governor.
Interpretation of the law was the arguments made in court.
The race is now between Democrat Phil Vasho and Republican Michael Backus.
County Clerk employee Susan Sweet has launched a write-in campaign. Candidates have less than one month to make themselves known to the voters.
