Court action taken on backdated documents

A State Supreme Court judge has taken an Ex Parte Term action to address the backdating of 13 judgments in the Oswego County Clerk’s office.

Court records show that Judge James McCarthy signed the orders July 20 in the matter of application of the Oswego County Clerk.

County legislators have called for an investigation into the backdating that allegedly occurred after someone threatened to sue the county because of the late filing of legal documents.

The clerk’s office had three employees in the court records department until the first of the year. An employee was promoted and moved to a different department, leaving the court records department short staffed.

The mail fell behind due to the lack of staffing and employees had said they are not allowed to sort through the mail to determine what may be timely. That led some legislators to question the operation of the clerk’s office.
