DA may appeal manslaughter ruling for Jones

Oswego County District Attorney Gregory Oakes is expected to appeal the decision by the Appellate Court to reinstate the murder conviction of Alan Jones, the Town of Palermo resident accused of killing his 11 year old step-sister, Erin Maxwell.

Jones was re-sentenced Wednesday morning for second-degree manslaughter. He had been serving a 25 year to life sentence. Oswego County Court Judge Walter Hafner sentenced Jones to the maximum of 5 to 15 years.

Jones was accused of choking Maxwell to death in their Palermo home while their parents were shopping. Jones’ lawyer, John Cirando, made a successful appeal to the state’s second-highest court, arguing that Jones should have been convicted of manslaughter, not murder.
